3. Which Data Categories Do We Use and Where Do They Come From?

The categories of personal data processed include, in particular:

- Your personal information (e.g., first name, last name, additional name details, nationality),

- Contact details (e.g., private address, email address, (mobile) phone number),

- Your professional resume, education, and schooling background.

This may also include special categories of personal data, such as health data, if you provide them in your resume. Such information is provided voluntarily, constituting consent, which can be revoked at any time by emailing office@everpharma.com.

Your personal data is typically collected directly from you during the application process. In certain cases, personal data may also be collected from other sources (especially authorities) due to legal requirements. Additionally, we may receive data from third parties (e.g., recruitment agencies).

If your personal data is not collected directly from you, we will inform you in advance.

4. Legal Basis, Purpose, and Duration of Data Processing

We process your personal data in accordance with the provisions of the EU General Data Protection Regulation (GDPR), applicable national laws such as the German Federal Data Protection Act (BDSG) for applications in Germany, the Austrian Data Protection Act (DSG), and other relevant laws (e.g., Works Constitution Act, Working Hours Act).

The purpose of data collection and processing is to manage the application process. The primary legal basis for this is Art. 6(1)(b) GDPR (for applications in Germany in conjunction with § 26(1) BDSG). If we decide to employ you, your application documents will become part of your personnel file for the duration of the employment relationship. This processing is necessary for the execution of the employment agreement (Art. 6(1)(b) GDPR).

If we do not select you, the data will be retained for a maximum of twelve months and then anonymized for statistical purposes, so it can no longer be traced back to you. The legal basis for this processing is our legitimate interest (Art. 6(1)(f) GDPR) in defending against legal claims in proceedings before the Austrian Equal Treatment Commission or in cases under the German General Equal Treatment Act (AGG), as well as for potential follow-up contact if the position remains unfilled.

With your explicit consent (Art. 6(1)(a) GDPR), we may retain your data for up to 12 months for inclusion in our talent pool, enabling us to contact you if other suitable positions become available during this period. Consent is voluntary and can be revoked at any time without providing a reason by emailing office@everpharma.com. Not providing consent will not affect the application process for the current position.

Should we process your personal data for any purpose not mentioned above, we will notify you in advance.

5. Rights of the Data Subject

You may request information about the personal data stored about you at the above address. Additionally, under certain conditions, you may request the rectification or deletion of your data. You may also have the right to restrict the processing of your data or request the transfer of the data you provided in a structured, commonly used, and machine-readable format.

Deletion of data will terminate the application process, and no further information can be provided about the procedure. After establishing an employment relationship, the right to data deletion or restriction is limited.

To exercise your rights, please contact the controllers mentioned above or the Data Protection Officer. You also have the right to lodge a complaint with a supervisory authority.

6. Data Transfer

No data transfer occurs outside the European Economic Area (EEA). Your data will generally not be shared with third parties. An exception is the transfer to data processors (e.g., service providers for the technical operation of the applicant management system) who work solely on EVER’s instructions, do not use the data for their own purposes, and are bound by data protection agreements under the GDPR.

7. Obligation to Provide Data

During the application process, you must provide the personal data required to establish the employment relationship or that we are legally obligated to collect. Additionally, where there is a legal obligation, certain data must be provided, such as a health certificate or criminal record certificate. Without this data, we will be unable to proceed with the employment contract.

8. Other Data Processing on This Website

When you access our website, information about your visit (date, time, viewed page, data volume, requesting IP address (anonymized)) is stored as log files on our server. This is based on the legitimate interest in ensuring the smooth operation of our information offering and optimizing it. These data are used solely for our statistical purposes in anonymized form.

For a more detailed analysis of website usage, we use Matomo, which stores technically necessary cookies on your device. The data is not shared with third parties or used for other purposes. The processing is in our legitimate interest to improve our website. Matomo is configured to immediately remove any personally identifiable information that may be transmitted for technical reasons (IP address). Data is deleted after 24 months.
